Court quashes election of monarch in Enugu

Justice Afam Nwobodo of the Enugu State High Court has nullified the purported election of Mr Victor Meniru as the traditional ruler of the Egwu Achi autonomous community in the Oji River Local Government Area of the state.

The court also restrained him from parading himself as the traditional ruler of the community and ordered for a fresh election within 90 days.

Not satisfied with the alleged subversion of the laid down processes of selection and installation of traditional rulers in the Egwu Achi community, Mr Okechukwu Onwuka, Rev. Fr. Martin Udejioforo and two others approached the court in suit number HOR/5/2010, on behalf of themselves and the Egwu Achi General Assembly, challenging the alleged election of Meniru as the traditional ruler of the community.

Joined in the suit were Meniru, Madu Raphael and Sir Joseph Azulu as defendants.

Delivering judgement in the matter, Justice Nwobodo declared the purported election as null and void and of no effect, and ordered Meniru to pay N50,000 to the plaintiffs as fine.

The judgment read in part, “That a declaration is made that any purported presentation of the 1st defendant (Meniru) to the Chairman of the Oji River Local Government Area and/or the Commissioner for Chieftaincy Matters, Enugu State, and/or the Enugu State governor, or the reception and/or recognition of the 1st defendant as the Igwe-elect or as the Igwe of Egwu Achi community is null, void and of no effect.

 “That the plaintiffs are allowed to organise and conduct an election between the defendants to the position of the Igwe Achi Autonomous Community in strict compliance with the constitution of the community and the Traditional Rulers’ law of Enugu State within 90 days.”

Justice Nwobodo also ruled that the local government chairman had no right under the Traditional Rulers’ Law of Enugu State to stop the plaintiffs from conducting election to the throne of the Igwe of the Egwu Achi Autonomous Community.
